Management says settlement does not affect financial position of company.

E-commerce outsourcer Digital River has settled, for an undisclosed amount and terms, the action brought by Christopher M. Crawford against Digital River, which had alleged infringement of United States Patent No. 6,014,651. Company management stated that the amount of the settlement was not considered material to the operations or financial position of the Company.

In August 2001, an action was brought against Digital River and other defendants in the U.S. District Court in the District of Columbia alleging infringement of United States Patent No. 6,014,651 owned by Christopher M. Crawford of Washington, D.C.

Crawford alleged that Digital River directly infringed the patent by the provision of online software purchase and delivery services; that Digital River actively induced infringement of the patent by supporting and otherwise promoting their electronic software delivery services to others; and that they contributed to the infringement of the patent by making, using, selling and offering to sell components of Digital River’s electronic software delivery services.
